No, you're full of shit. Any substantial modification of an existing creation is a derivative work, substantial being anything besides "touch-ups" like removing specks or scratches from a photograph or painting, or fixing typos in a literary piece. Large-scale palette shifts are clearly derivative works since they change the context of the piece and not simply the presentation of it. They're just as much a derivative work as L.H.O.O.Q. which you even cited – which probaly took less time than the edits in this thread. Even spending 30 seconds typing LOL I CAN HAS CHEEZBURGER and clicking save qualifies as a derivative work, because it affects the presentation of the subject.
If you still want to live in your happyland with whatever fucked-up definition of a derivative work you seem to have, please elaborate on your opinion of Andy Warhol's Colored Campbell's Soup Cans (e.g. http://www.learn.columbia.edu/warhol/campbells/).
